1.1 These GTC apply to the use of the online platform www.nomady.camp ("Nomady") and the Nomady app (nomady.camp), regardless of whether you use them as a host or as a camper. Our Nomady Pact is also important to us. You can find it here.
1.2 All Nomady offers and services are provided exclusively on the basis of these GTC. Possible terms and conditions of users do not apply. This also applies if Nomady has not expressly objected to the terms and conditions of users.
2.1 Nature lovers who have discovered the growing need for accommodation close to nature. We operate Nomady AG, Eisenbahnstrasse 7, 8840 Einsiedeln (UID CHE-259.964.605), which in turn operates www.nomady.camp. The service partner is Nomady Germany UG, Turmstrasse 5, 78467 Konstanz, which is also authorized to make contact.
3.1 Nomady provides its users with a platform via the website www.nomady.camp and the Nomady app (nomady.camp), through which camping and overnight accommodation can be arranged for a fee. Providers of camping or overnight accommodation are called "hosts" and advertise their offer ("camping opportunity") on the platform, which can then be booked by "campers". "Users" of Nomady can be hosts as well as campers. These terms and conditions apply to both user categories, although separate terms and conditions apply in some cases depending on the user group (see section 24 for hosts and section 25 for campers).
3.2 Camping facilities can be: pitches for mobile homes, tent pitches, cabins or other accommodation. Hosts and campers may be private individuals or legal entities.
4.1 A nature-loving community that is committed to the Nomady Pact and wants to offer and experience sustainable and low-impact tourism off the beaten track. Camping off the beaten track. Everyone who registers for Nomady agrees to the Nomady Pact - and it is important to us that this spirit is lived.
5.1 Our business is the platform. We mediate and we do this by providing the technical framework for mediating the camping opportunity between the host and the camper. Nomady charges both the host and the camper a small fee for this. Payments can be processed directly via the Nomady platform. For regulatory reasons, however, we do not do this ourselves, but work together with the licensed provider Stripe Connect, with whom you also enter into a contractual relationship. Nomady itself does not provide camping facilities.
5.2 There is no employment relationship between Nomady and the hosts or campers and we do not form a simple partnership. Nomady is not authorized to issue instructions to either hosts or campers and vice versa.
5.3 All rights and obligations arising from the contract for the use of a camping facility arise exclusively between the hosts and the campers. Hosts provide the services offered to campers exclusively in their own name and for their own account and responsibility and only campers are liable to hosts for the contractual use of the camping facility.
6.1 Surfing on www.nomady.camp and the app is of course possible without registration. Take a look around!
6.2 However, posting camping opportunities or using the booking functions requires prior registration as a user. Users can be hosts or campers. Users must be of legal age and have unlimited legal capacity. Users can be natural persons or legal entities.
6.3 Registration can take place via the "Register" input screen or via the login from the following online portals: Google, Facebook, Linkedin (for information on the data protection aspects of this type of login, see our Privacy Policy).
6.4 After registering, you will receive an automated email from Nomady. The "user contract" between Nomady and you as a user, which is regulated in these GTC, is concluded when you confirm the link sent in the confirmation email.
6.5 When registering, you must provide truthful and complete information. Data from third parties may not be used. The "user account" is not transferable.
6.6 Please always keep your registration data up to date and treat your access data, in particular your password, as strictly confidential. If you discover that an unauthorized third party has used your account, please inform Nomady immediately so that damage can be avoided as far as possible.
7.1 Nomady and the graphic representation are internationally registered and protected trademarks. You may not use, modify, create derivative or similar representations of them or use them in communications of any kind without our written consent.
8.1 By registering your user account and entering into the user agreement between Nomady and you, we grant you a limited, non-exclusive, non-transferable and revocable license to use Nomady in accordance with these GTC.
9.1 For the sole purpose of operating the Platform, you grant Nomady a non-exclusive, royalty-free, non-transferable, non-sublicensable, worldwide license to use, store, display, reproduce, perform, distribute or similarly exploit the content posted by you ("User Content") on Nomady. This applies in particular to the images you post and your contact details.
9.2 We reserve the right to review, remove or edit your User Content at our sole discretion.** This applies in particular to content that we consider to be in breach of these T&Cs. See also sections 27 and 28.
10.1 The contract of use is entered into for an indefinite period. It can be terminated at any time by sending a short email or by deleting your user account.
10.2 If you are a host, please note that the deletion of your user account will result in the cancellation of all bookings confirmed at that time and the campers will receive a full refund of the rental fees already paid in advance (see also sections 17 and 17.3). As the host, you are liable for the receivables in the form of the guest and host service fee. The fees are bundled and invoiced by Nomady AG.
10.3 If you delete your user account as a camper, all your bookings will be automatically canceled. Please note, however, that the cancellation rules stated in the booked offer still apply. A refund of the camping fees you have already paid may therefore not be due in all cases. Since you delete your account in full knowledge of this, you must also assume the risk. Neither Nomady nor the host is liable to you for this (see also sections 17 and 17.3).
10.4 With the deletion of your user account, the user content you have posted on Nomady will be irretrievably deleted. You are not entitled to have your data restored.
11.1 We will only delete your user account if you leave us no other choice ("extraordinary termination"). This is the case if you seriously violate these GTC or the Nomady Pact or if justified complaints are received about you or a person from your environment in connection with the use of Nomady or a rental contract with the host or camper or if you otherwise stand out due to behavior that violates the law or the contract.
11.2 The consequences of this for your user content or, if you are a host, for your bookings, can be seen in Section 10. Nomady is not liable for this loss of earnings because the deletion of your host account was provoked by your own misconduct.
11.3 Apart from this, we may of course wish to discontinue the operation of the platform. We reserve this right. If the platform is discontinued, the user agreement between us will also be terminated. We will, of course, inform you of this as early as possible and take precautions to ensure that no one is harmed as a result.
12.1 The license to use Nomady (see section 8.1) itself is free of charge. Fees only apply if you book camping facilities via Nomady or if you rent your camping facility to a camper via Nomady.
12.2 As a camper, you will be shown during the booking process exactly how high the camping fees and how high our fees are. You have full transparency at all times and decide to book with full knowledge of the fees involved.
12.3 Before paying out the rental price to hosts, Stripe Connect (see below) deducts the fees owed to us from the rental price. As a host, you will therefore only receive the net amount of your rental price agreed with the camper. As a host, you will be informed of the currently applicable Nomady fees when you register your offer.
12.4 If you want to check the current fees, you can find them here. Nomady reserves the right to adjust the fees from time to time and with effect for future bookings only. You will be informed of this in an appropriate manner.
12.5 Please take note of our cancellation conditions (see section 17). Nomady fees also apply in the event of cancellation.
13.1 We use the services of Stripe Connect to handle the payment process between the camper and the host. Stripe Connect is a licensed provider that accepts payments in favor of the hosts on its regulated customer money bank account and then pays these out to the entitled hosts or to Nomady to the extent of the fee owed.
13.2 Stripe Connect maintains direct contractual relationships with both the Host and Nomady to manage the processing of payments to the Host and fees to Nomady. Funds owed by the camper to the host never come into the possession of Nomady and are not controlled by Nomady. Rather, these funds are deposited into Stripe's regulated customer money bank account in favor of the seller or Nomady and are then paid out by Stripe to the seller or Nomady. This saves you and us a lot of regulatory work and allows us to concentrate on what is really important.
13.3 As a host, you register directly with Stripe in a separate process when setting up your user account and accept their terms and conditions (the Stripe Connect Account Agreement). You can find the Stripe Connect terms and conditions here
. No claims can arise against Nomady with regard to the payment process, which is why Nomady assumes neither warranty nor liability for this.
13.4 As a camper, you pay the camping and Nomady fees owed directly with the selected payment method. Of course, all conditions of the financial institution with which you have entered into your contract apply. Nomady has nothing to do with this and therefore accepts no liability or warranty.
13.5 Your means of payment will only be debited if the booking is accepted. In the case of a direct booking, this may be the case immediately; if the host actually confirms your booking by email, the booking is only concluded with the confirmation email. If your booking is declined, you will of course not be charged.
14.1 We've already mentioned it, but it's important, so here it is again: We only mediate. The heart of Nomady is the "camping contract" between host and camper for the use of the host's property or cabin. The camping contract is concluded exclusively between the host and the camper - Nomady has nothing to do with it and is not a party to the camping contract. Legally speaking, the camping contract is a rental contract. You can imagine what this means. You rent something in order to be able to use it for a fee.
15.1 The camping contract is concluded with the written confirmation (e-mail) of the booking request by the host, with which he answers the booking request of a camper regarding an advertisement posted by the host on Nomady. In the case of direct bookings, this e-mail is generated automatically.
15.2 The content of the camping contract is based on the specifications made in the advertisement. Essentially, you rent a spot of land for the price stated in the advertisement to pitch your tent, bus or camper, or you book a room in a hut or other overnight accommodation. Further details and costs regarding sanitary facilities, fireplaces, firewood etc. and the associated costs can also be found in the advertisement.
16.1 The camping contract ends automatically with your departure on the agreed date.
17.1 If you wish to cancel your camping experience before it even takes place, then the cancellation conditions stated in the advertisement apply. Please note them carefully before canceling your booking.
17.2 Nomady offers the following cancelation options:
Super Flex: The camper can cancel up to the check-in time on the arrival date and receive the entire booking amount minus the entire Nomady service fee back from the host. The date of arrival and the check-in time (minus 24 hours) are decisive for the calculation of the deadline. "Total Nomady service fee" means that you must also pay the portion of fees that would have been paid by the host if the camping contract had been executed.
Flex: The camper can cancel up to 24 hours before arrival and receive the entire booking amount minus the total Nomady service fee back from the host. The date of arrival and the check-in time (minus 24 hours) are decisive for the calculation of the deadline. "Total Nomady service fee" means that you must also pay the proportion of fees that would have been paid by the host if the camping contract had been carried out.
Easy: The camper can cancel up to 3 days before arrival and receive the entire booking amount minus the total Nomady service fee back from the host. The date of arrival (minus three calendar days) is decisive for the calculation of the deadline. "Total Nomady service fee" means that you must also pay the proportion of fees that would have been paid by the host if the camping contract had been carried out.
Means: The camper can cancel up to 10 days before arrival and receive the entire booking amount minus the total Nomady service fee back from the host. The date of arrival is decisive for calculating the deadline (minus 10 calendar days) "Total Nomady service fee" means that you must also pay the proportion of fees that would have been paid by the host if the camping contract had been carried out.
Strictly: The camper can cancel up to 30 days before arrival and receive the entire booking amount minus the total Nomady service fee back from the host. The date of arrival is decisive for calculating the deadline (minus 30 calendar days) "Total Nomady service fee" means that you must also pay the proportion of fees that would have been covered by the host if the camping contract had been carried out.
None: The camper has no option to cancel. They owe the entire booking amount including the Nomady service fee owed by them, even if they do not use the camp during the booked period. A refund is excluded.
17.3 You will therefore not get your money back in every case and you will never get all your money back - you must always pay the Nomady service fee for you and the host in the event of cancellation. Nomady also disclaims any liability for other non-refundable fees or rental charges. Stripe Connect will only refund you the listing price minus our total fee.
18.1 Because you are the only parties to the camping contract, if things don't go as they should between you, you must sort them out yourselves. Nomady disclaims any liability and warranty for claims arising from the camping contract itself and does not see itself as an arbitration board or guarantor for smooth camping experiences. Incidentally, Swiss law applies to the camping contract as long as the camping facility is located on Swiss soil. So if you have any legal disputes arising from a Swiss camping contract, ask a Swiss lawyer. Otherwise, contact a lawyer in the country where you are camping.
18.2 We have already mentioned the Nomady Pact and will return to it here. It is important to us that the common spirit that we express in the pact is lived. If everyone treats each other according to these simple (and actually self-evident) rules, where could any problems arise?
19.1 So that you as a camper can compare different offers at a glance, the "basic price" stated in the advertisement always applies to one night and one person in the accommodation.
19.2 Information on the base price and on prices for overnight stays for additional persons or additional services such as firewood or breakfast, cleaning fees, any visitor's taxes, taxes and duties of all kinds, etc. can be found in the corresponding advertisement on Nomady. Their determination is at the sole discretion of the host (at least as long as they are not taxes or other public charges).
19.3 Nomady has no influence on pricing and therefore accepts no liability in this regard.
20.1 If your camping site is located in a municipality that levies visitor's tax, you as the host may also have to collect or pay visitor's tax for the rental of your camping site. It is your own responsibility to clarify this with your municipality in advance. Nomady declines all liability in connection with visitor's tax.
20.2 So that you are not unpleasantly surprised by any visitor's tax owed, Nomady has provided a field in the input mask for new camping offers that asks precisely about this. It is best to clarify this question immediately and only place your offer on Nomady once this point has been clarified.
20.3 Nomady is under no circumstances liable for the tourist taxes owed by you. They are solely your responsibility. If you breach your obligations in this regard, you alone are responsible for this. Should Nomady be held liable for this, you must assume the full amount of the claim asserted, including all ancillary costs (e.g. legal fees and court costs).
21.1 As the host, you are responsible for determining whether and to what extent you are obliged to pay VAT or any other type of taxes, fees or duties on the income from the rental of any offers. You are also responsible for including these taxes, fees or charges in your listing price. Please clarify these issues with your municipality/region before placing listings on Nomady.
21.2 Nomady is under no circumstances liable for the taxes you owe. They are solely your responsibility. If you violate your obligations in this regard, you are solely responsible for this. If a claim is made against Nomady, you must pay the full amount of the claim, including all ancillary costs (e.g. legal fees and court costs).
22.1 All insurances are the sole responsibility of the users. Nomady recommends that all users take out comprehensive insurance cover before camping.
22.2 Nomady is in no way liable for damage to property, financial loss or personal injury or damage of any other kind that may occur in connection with the camping contract. If a claim is made against Nomady due to a lack of insurance cover for its users, you must assume the full amount of the claim asserted, including all ancillary costs (e.g. legal fees and court costs).
23.1 Campers and hosts can leave a public review within a certain period of time after completing a booking and rate each other by means of a star rating. All ratings and reviews reflect the opinions of the individual users and not the opinion of Nomady. Ratings and reviews are not checked for accuracy by Nomady and may be inaccurate or misleading.
23.2 Ratings and reviews of campers and hosts must be accurate and must not be offensive or defamatory or otherwise illegal or objectionable. Sections 27 - 33 apply to user content. Nomady reserves the right to make changes in exceptional cases. These will be communicated to the guest and host.
24.1 If you place an advertisement on Nomady, please provide complete and correct information. Point out any shortcomings or requirements that need to be met. And please keep your listing up to date, especially the availability dates.
24.2 The content of your advertisement and the way in which you describe your offer is binding on the Camper. This means that you are liable to the Camper for the correct fulfillment of the offer (see also section 18).
24.3 You are solely responsible for setting a price (including any applicable taxes, tourist taxes or additional fees, such as a cleaning fee) for your advertisement. As soon as a camper requests a booking for your offer, you may not charge the camper a higher price than the price applicable at the time of the booking request.
24.4 Terms and conditions contained in your Listing, in particular in relation to cancelations, must not be inconsistent with these Terms of Use.
24.5 Once you have accepted a Camper's booking request using the direct booking tool or following an email confirmation, you will enter into a legally binding contract with the Camper (the Camping Contract, see above) and must then provide your Host Service as described in your Listing at the time of the booking request. You are also obliged to pay the relevant host fees and any applicable taxes.
24.6 Nomady recommends that Hosts ensure they have adequate insurance cover. Seek advice on your situation from an insurance specialist.
24.7 All your offers must be in compliance with the relevant laws, tax requirements and other rules and regulations applicable to you (including but not limited to all governmental permits, licenses and registrations).
24.8 Nomady disclaims all liability if a claim is made against you for failure to comply with these points.
24.9 For marketing reasons, Nomady places offers on verified partner websites of third parties. Only public information is used and a link to the Nomady advertisement is ensured. In addition, the respective terms and conditions of the partner platform apply.
25.1 Before you book a camping option, you will be shown all costs, including the listing price, fees for Nomady's services and any applicable taxes or fees. When you make the booking, you agree to pay these fees in full.
25.2 Upon receipt of a booking confirmation, a binding contract is formed between you and the Host, which is subject to the relevant cancellation policy and any other rules and restrictions stated in the listing.
25.3 As a camper, you are responsible for leaving the camp in the condition in which you found it.
26.1 Before we turn to liability issues: The most important factor for quality assurance on an internet platform like Nomady is self-regulation. Join in! All users are invited to rate the offers they use truthfully and to leave objective and helpful comments (see below for the rules). This is an extremely effective means of quality control, because who wants to get bad ratings and thus worsen their chances on Nomady?
26.2 Please report to us here immediately if you come across abusive or illegal offers, content or behavior. This is the only way we can react and protect our community from such behavior.
27.1 Nomady offers you and other users a positive place where you can discover great camping opportunities. To keep it that way, you are obliged to comply with these T&Cs. This applies in particular to all details, images and other information that you post on Nomady ("User Content").
27.2 All rights to the User Content that you post on Nomady, as well as the sole responsibility for it, remain with you. You represent and warrant that your User Content complies with all applicable laws and regulations.
27.3 Posting User Content that violates the law or is otherwise inappropriate or offensive is prohibited. If you do so anyway, you will be liable for damages to Nomady and other injured third parties.
27.4 As the host, you confirm that you provide the services offered to the camper exclusively on your own responsibility and in your own name and that you comply with all legal framework conditions for the execution of the camping contract without exception. This includes that you fulfill the necessary legal requirements in order to be allowed to provide the offered services at all. You confirm that you have obtained all necessary licenses, permits or registrations before you advertise camping opportunities on Nomady.
28.1 Like all Internet platforms, Nomady cannot verify the identity of registered users or the accuracy, authenticity, timeliness, completeness, quality, safety, suitability or legality of the offers they post. We therefore assume no liability for the correctness of the information provided by users and their offers and accept no liability whatsoever for false information provided by other users.
28.2 Nomady does its best to ensure that only offers from reputable hosts are presented on the platform and that the information about the users and the type and availability of the camping option offered is complete, correct and up-to-date. To this end, Nomady reserves the right to request official identification documents or other information from users to verify the identity of the user or the authenticity and correctness of the posted offer. If a user refuses this verification process, Nomady reserves the right to delete their user account, including all data contained therein, for security reasons. Despite all due care, it can still happen that errors or even fraudulent offers creep onto our platform.
28.3 Please do your part and let us know here immediately if something seems suspicious. And always exercise due diligence when contacting an unknown host and making a booking.
29.1 Nomady disclaims all liability for content that you or other users post on Nomady.
29.2 If you post user content, please note that it must not be illegal in any way, must not contain any depictions of violence and must not be sexually offensive. They must also not contain any discriminatory, offensive, racist, defamatory or otherwise unlawful or immoral statements or representations. User contributions must not contain any inaccurate factual claims. And they must not infringe the rights of third parties, e.g. their name, trademark, copyright, personal rights, etc. Such content is referred to below as "problematic content".
29.3 Nomady accepts no liability whatsoever for problematic content posted by users. If you post problematic content, you must bear the full legal consequences yourself (criminal charges, reports and claims for copyright infringement, etc.). If Nomady or other users are harmed by problematic content, you are also liable both to Nomady and to the users harmed by your problematic content.
29.4 We will delete your problematic content immediately if we identify it as such. We reserve the right to delete your user account.
29.5 As a user, you hereby acknowledge that you may be confronted with user content that is problematic in the above sense. We endeavor to detect such content and delete it in good time, but if you are confronted with it, we decline all liability for it. Please inform us immediately if you come across problematic content.
30.1 The most common infringement of third-party rights is certainly the use of images belonging to a third party. By doing so, you violate their copyrights to the images used.
30.2 Should Nomady be held liable by a third party due to a copyright infringement by you, you must indemnify us in full.
30.3 It is best to use only your own images.
30.4 However, as a general rule, you are not authorized to use, copy, adapt, modify or in any way exploit any Nomady content that is not your own.
31.1 In some cases, we at Nomady create the images for host listings ourselves. We are happy to do so and gladly grant you the right to use these images as part of your offer on Nomady. However, all rights to the images remain fully with Nomady. You may not use them outside of Nomady without our prior written consent.
32.1 There may be links on Nomady that lead to websites, services, special offers or other activities of third parties or advertisers ("external content") that are not owned or controlled by Nomady. Nomady does not recommend this external content and accepts no responsibility for it.
32.2 Access to the External Content is at your own risk and Nomady disclaims any responsibility for your knowledge or use of the External Content.
33.1 The security of our users is extremely important to us. Although we make every effort to protect the platform, your content and your account, Nomady cannot guarantee that unauthorized third parties will not succeed in breaching our security measures. We ask you to keep your password safe. Please notify us immediately if you become aware that your account security has been compromised or accessed without authorization.
34.1 Any liability of Nomady is excluded to the extent permitted by Swiss law. This applies in particular to slight negligence. We also exclude any liability for the actions of our auxiliary persons. Finally, it goes without saying that we are also not liable for failures or malfunctions of the Internet and telecommunications infrastructure that lead to an impairment of the functionality of Nomady.
34.2 In particular, Nomady is not liable for the identity of the users and not for the accuracy of the information and user content that users provide on their own responsibility in their advertisements on Nomady. Please notify us immediately if you come across information and user content that is incorrect so that we can admonish the offending user and, if necessary, ban them from Nomady.
34.3 Furthermore, Nomady is not liable for a flawless camping experience. If this does not correspond to the information in the advertisement on Nomady or otherwise to your expectations, you must refer exclusively to your host with regard to any warranty or liability claims.
34.4 Conversely, Nomady is not liable for the actions or omissions of campers that they perform or fail to perform in connection with the execution of the camping contract. In particular, Nomady is not liable for damage caused by campers.
34.5 Nomady is not liable for any form of charges, fees, taxes, duties, etc. that may be owed by you. It is the sole responsibility of the host to clarify whether such charges etc. may be due and we recommend that you do this before you advertise your camping options on Nomady.
34.6 Nomady is also not liable for any kind of permits, registrations, notifications, etc. that hosts must obtain from authorities before they are allowed to rent out campsites.
35.1 Now you know the conditions. If you breach them, you will be liable to pay compensation to us and third parties. More precisely:
35.2 In the event of non-contractual or unlawful use of the user account, you must indemnify Nomady in full. In particular, you must compensate Nomady for all damages resulting from the misuse of your user account, including, but not limited to, compensation for damages that Nomady must pay to third parties, legal fees and court costs, fines and fees, etc.
35.3 In the event that you use the platform in breach of contract or unlawfully or fail to comply with these GTC or the Nomady Pact, Nomady is entitled to delete your user account without prior warning. Nomady accepts no liability for any damage or loss of data caused as a result. There is no entitlement to restoration of the deleted user account. Once deleted, you may not open a new user account using different login data.
35.4 If claims are made against us by a third party due to actions you have committed, you are obliged to indemnify us in full against these claims and to pay full compensation. You specifically agree to indemnify, defend (at Nomady's option) and hold Nomady and its officers, employees and agents harmless, at your expense, from and against all claims for damages, liabilities, damages, losses and expenses, including the costs of any necessary legal defense and/or accounting fees, arising out of or in any way connected with (i) your violation of these Terms of Use, (ii) your improper use of the Nomady Platform, (iii) your interaction with a User, (iv) your stay at a Camping Facility, or (v) your violation of any law, regulation or third party right. This does not apply if you are not responsible for the infringement.
35.5 You agree to pay all legal fees, court costs and any party indemnification costs that may be incurred in the course of a lawsuit to defend the claims asserted against Nomady. You will be liable to us in the same way even if we lose the case. We reserve the right to serve you with notice of the dispute in the event of a lawsuit.
36.1 The detailed contract text in this right-hand column of the GTC is legally binding. The short summaries in the titles and in the left-hand column of these GTC are provided solely in the interest of a quick overview and user-friendliness. In the event of discrepancies, the detailed contract text in this right-hand column shall take precedence over the short text or the titles.
37.1 The collection, processing and use of your personal data, which is disclosed to Nomady within the scope of the user contract or which Nomady collects, is carried out in accordance with the provisions of the Swiss Federal Act on Data Protection (SR 235.1). The details can be found in the Data Protection Policy.
38.1 Nomady reserves the right to amend these GTC or other provisions such as the fee schedule at any time. In this case, you will be informed by email in good time before the new conditions come into force. If you do not agree with the new terms and conditions, you must inform us or delete your user account. If you do not do this, you will be deemed to have accepted the new terms when they come into force. You will be informed of these options in our email.
39.1 This clause means nothing other than that in the event that one of the provisions of these GTC cannot be applied for legal reasons, it shall be replaced by a provision that comes as close as possible to it. The validity of the contract of use and the remaining provisions of these GTC shall not be called into question by the invalidity of one or more clauses.
40.1 The place of jurisdiction for all disputes arising from this contract of use is exclusively at the registered office of Nomady. Swiss law shall apply exclusively, excluding conflict of laws provisions and the Vienna Sales Convention.
